1. RELATIONSHIP TO OTHER DOCUMENTS
These Terms apply to public use of the Site, including browsing, Request Info and Contact forms, employer pages, and credential lookup.
If you enroll in a program, the Universal Single User Enrollment Agreement also applies and controls if there is a conflict about enrollment, assessment, payment, refunds, or credentials.
Our Privacy Policy explains how we collect and use personal information. Our Refund & Cancellation Policy explains cancellation after enrollment. Those documents are part of your use of the Site where they apply.
2. WHO WE ARE AND WHAT THE SITE IS
American Professional School is a Montana vocational and professional development organization offering online, non-degree Continuing Professional Education. Instruction and learner services are delivered online. The Kalispell address is the registered office and corporate mailing address.
The Site describes competency-based Continuing Professional Education pathways. After you demonstrate the required competencies and the School approves completion, you may receive a Dual Integrated Industry Credential: an occupational diploma together with the corresponding Certified designation at the Professional, Master, or Executive level. Those names mark vocational practice levels in APS programs.
The Site is information and access to forms and tools. Browsing the Site does not enroll you, reserve a seat, or create a promise of admission or a credential.
3. ELIGIBILITY
You must be able to form a binding contract. Programs are designed for working adults and are generally limited to individuals 18 or older. A minor may use enrollment-related services only with documented parent or guardian consent as described in the Enrollment Agreement.
You may not use the Site if you are barred from doing so under U.S. law, including export and sanctions rules.
4. ACCOUNTS AND FORMS
Some features require a form or login. You agree that information you submit is accurate and that you are authorized to submit it. You are responsible for keeping any password confidential and for activity under your account or email address.
We reserve the right to refuse, suspend, or terminate your access to the Site or your account at any time, for any reason, at our sole and absolute discretion, without notice or liability.
5. ACCEPTABLE USE
You may use the Site only for lawful purposes and in accordance with these Terms. You may not:
• Scrape, crawl, or copy the Site in bulk except through ordinary browser use or a public search engine
• Bypass security, rate limits, or access controls
• Probe or attack the Site
• Upload malware or harmful code
• Impersonate any person or misrepresent your affiliation
• Complete or attempt to complete an assessment for another person, or allow another person to complete one for you
• Use automated tools to obtain assessment answers
• Harvest personal information from the verification tool beyond a legitimate verification of a credential you are authorized to check
• Post or transmit content that is unlawful, defamatory, infringing, or harassing
• Misrepresent your affiliation with the School or use School names or marks in an unauthorized way
We may remove content or block access that violates this Section.
5A. LEARNER CODE OF CONDUCT
Learners enrolled in APS programs are expected to participate in a professional and respectful manner and to uphold the integrity of competency demonstration. Expected conduct includes:
• Engaging respectfully with APS staff, contractors, and other learners in all communications
• Submitting authentic evidence that represents your own work and professional capability
• Following published competency demonstration requirements and instructions
• Refraining from harassment, bullying, intimidation, or discriminatory conduct
• Using APS platforms and communications only for legitimate program-related purposes
Integrity rules (including prohibitions on plagiarism, collusion, impersonation, fabrication of evidence, and unauthorized assistance) are set out in the Academic Integrity and Malpractice Policy and the Competency Demonstration, Appeals, and Academic Integrity Policy. Suspected breaches are investigated under those policies.
Proportionate consequences for misconduct may include a written warning, requirement to resubmit authentic evidence, disallowance of submitted evidence, temporary suspension of access, denial of credential eligibility, or removal from the program. Serious or repeated breaches may also result in notification to an employer or other relevant party where appropriate and lawful. Learners have the right to respond during an investigation and to appeal outcomes as described in the applicable policies. Raising a concern or appeal in good faith will not result in retaliation.
6. PROGRAM INFORMATION ON THE SITE
Program descriptions, competency maps, track availability, support descriptions, and schedules on the Site may change.
The prices that apply to an enrollment are the tuition, credentialing fee, and any installment plan disclosed to you at enrollment or, for amounts that become due only at completion, at credential approval. The public price list on the Site may be updated from time to time and applies to new enrollments after the update.
Graduate-First means you pay nothing to begin and nothing while working through the program. Amounts become due only after you demonstrate the required competencies and the School approves you for the credential. That plan is not an income-share agreement and not a job-contingent loan.
Competency-based education focuses on demonstrated skills rather than seat time. Many employers value candidates who can show concrete abilities through practical assessments and a named competency record. Employer practices vary by industry and company. Completion of an APS pathway is intended to show that the holder demonstrated the ability to apply concepts in practical situations.
Using the Site does not by itself admit you to a program or set a completion date. Hiring, promotion, and professional licensure decisions remain with the employer or licensing body. APS pathways do not award college credit and are not federal student-aid programs.
7. CREDENTIALS AND VERIFICATION
If a credential is issued, employers and other third parties may confirm issuance, date, authorized title, and Oath status at https://americanprofessionalschool.org/verify using last name and Credential ID. Basic checks do not require a login.
Verification confirms that APS issued the credential and shows the authorized title and related credential facts so an employer can include them in a skills-first review. It documents an APS vocational credential. It is not a college degree and not an occupational license.
You may use the verification tool only to confirm a credential you are authorized to check. You may not use it to build marketing lists, profile individuals unrelated to a legitimate verification, or attempt to extract the registry in bulk.
8. INTELLECTUAL PROPERTY
The Site, including text, graphics, logos, competency maps, module content, software, and trademarks, is owned by the School or its licensors and is protected by U.S. and other law. We grant you a limited, revocable, non-transferable license to view the Site for personal, non-commercial use and to print a reasonable number of pages for that use, with notices intact.
You may not copy, modify, distribute, publicly display, or create derivative works from Site content except as allowed above, by another written license, or by mandatory law (including fair use).
“American Professional School,” related logos, and Certified designation names are identifiers of the School. You may state that you hold an issued American Professional School credential, using the authorized title. You may not use School marks to imply partnership or endorsement that does not exist.
9. USER CONTENT
If you submit comments, form responses, documents, or other content, you grant the School a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display that content for any purpose, including marketing and promotional purposes. You represent that you have the right to submit the content and that it does not infringe others’ rights.
We do not claim ownership of your pre-existing resume or work samples except for the limited license above.
10. COPYRIGHT COMPLAINTS
If you believe material on the Site infringes your copyright, send a notice that meets 17 U.S.C. § 512(c)(3) to contact@americanprofessionalschool.org with the subject line “DMCA,” or to the Kalispell address, Attn: DMCA Agent. Include your signature, the work claimed to be infringed, the location of the material, your contact information, a good-faith belief statement, and a perjury statement of authorization. Counter-notifications may be sent to the same address in the form required by 17 U.S.C. § 512(g)(3). Details are also in the Enrollment Agreement.
11. THIRD-PARTY LINKS AND TOOLS
The Site may link to third-party sites and services, including credential registries and professional networks. We do not control those sites and are not responsible for their content or practices. Links are not endorsement. Payment, analytics, hosting, email, notary, and shipping providers process data under their own terms as well as our instructions.
12. PRIVACY
Use of the Site is also subject to our Privacy Policy. Do not submit information you do not want processed as described there.
13. DISCLAIMER OF WARRANTIES
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CODE.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SCHOOL AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM USE OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. THESE LIMITATIONS ARE AN ESSENTIAL PART OF THESE TERMS. NOTHING LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
15. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the School and its officers, directors, employees, and agents from claims, damages, and reasonable attorneys’ fees arising out of: (a) your breach of these Terms; or (b) your use or misuse of the Site or verification tool. This does not apply to claims arising from the School’s gross negligence, willful misconduct, or fraud.
16. EXPORT
You may not use or export the Site or its technology in violation of U.S. export or sanctions law, including use in an embargoed country or by a denied party.
17. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-laws principles.
If you have enrolled, the Enrollment Agreement governs enrollment disputes.
For questions or complaints about the Site, email contact@americanprofessionalschool.org first. If a Site-only dispute remains, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration, rather than in court. You and the School agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
18. CHANGES
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the Site. If a material change is adverse to you and you have an active enrollment, the Enrollment Agreement’s change and cancellation rules apply to that enrollment. Your continued use of the Site constitutes your binding acceptance of the updated Terms.
19. GENERAL
If any provision is unenforceable, it will be limited to the minimum extent necessary so the rest remains in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any Enrollment Agreement you accept, are the entire agreement for their subject matter. You may not assign these Terms without our consent. We may assign them in connection with a reorganization or transfer of the organization. Headings are for convenience only.
